1. About these Terms

These Terms of Service (the “Terms”) govern your access to and use of animaglass.com, including purchases made through the website and any related content, features and customer services (collectively, the “Services”).

The website is operated under the Animaglass brand by Vivid Studio SRL, with its registered address at Bd. Luptatorilor 62–64, ap. 14, Bucharest 013307, Romania, VAT number RO27888164 and Trade Register number J2011000191403 (“Animaglass”, “we”, “us” or “our”).

Our online store is hosted by Shopify, which provides the ecommerce platform that enables us to offer the Services. Purchases made through the store are contracts directly between you and Animaglass, not Shopify.

By accessing the website or placing an order, you agree to these Terms and to the policies referenced in them. If you do not agree, please do not use the Services.

Nothing in these Terms excludes, restricts or replaces any mandatory rights available to consumers under applicable Romanian or European Union law, including statutory withdrawal rights and the legal guarantee of conformity.

2. Eligibility and accounts

You must have the legal capacity to enter into a contract under the law applicable in your country of residence. If you are under the applicable age of majority, you may use the Services only with the involvement and consent of a parent or legal guardian.

You agree to provide accurate, current and complete information when placing an order or creating an account. You are responsible for protecting your account credentials and for activity carried out through your account. Please contact us promptly if you believe your account has been accessed without authorisation.

Accounts may not be sold, transferred or used for unlawful or fraudulent purposes.

3. Products and compatibility

Animaglass creates modular iPhone cases with interchangeable 3D lenticular backplates. A complete case set includes one compatible Animaglass case in the selected colour and one interchangeable backplate. Standalone backplates are sold separately for customers who already have a compatible Animaglass case.

Products and backplates are model-specific. The compatible iPhone model is identified in the product title and product information. Please check your exact phone model before ordering. If you are uncertain, contact us before placing the order.

We make reasonable efforts to display and describe our products accurately. Colours may appear differently depending on the screen, device settings and lighting. The appearance of a lenticular image also changes with the viewing angle and lighting conditions; this variation is an intended characteristic of the product rather than a defect.

Minor variations may occur between individual products as a result of the production process, provided that the product remains consistent with its description and intended use. Nothing in this section limits your rights where a product is defective, damaged, incorrectly supplied or otherwise not in conformity with the contract.

We may update product descriptions, discontinue products or limit available quantities. Changes will not affect orders already accepted by us.

4. Orders and contract formation

By submitting an order, you offer to purchase the selected products under these Terms. After receiving your order, we will send an electronic acknowledgement or order confirmation. The purchase contract is formed when we confirm acceptance of the order following successful payment.

Please review the products, phone model, case colour, delivery address and contact information before submitting your order.

We may refuse or cancel an order where, for example:

• the product is unavailable;

• payment cannot be authorised;

• the price or product information contains an obvious error;

• the delivery destination is outside the regions we serve;

• we reasonably suspect fraud, unlawful activity or commercial resale; or

• an order exceeds reasonable quantity limits.

If we cancel an order after payment has been collected, we will return the applicable amount using the original payment method without undue delay.

If you wish to cancel or change an order, contact us as soon as possible. We will try to assist, but we may be unable to change an order once processing or dispatch has begun. Your statutory withdrawal rights and the rights described in our Refund Policy remain unaffected.

5. Prices, VAT and payment

Prices displayed to consumers include applicable VAT unless clearly stated otherwise. Available delivery methods and their charges are shown before you submit an order. The total amount payable is displayed at checkout before you confirm payment.

For destinations where customs duties, import taxes or similar charges may apply, those charges may be collected separately by the relevant authorities or carrier unless we expressly state that they are included. The customer is responsible for such charges where permitted by applicable law.

Prices and promotions may change, but changes will not affect orders already accepted. Promotional offers may have additional conditions. If the conditions of a promotion conflict with these Terms, the promotion-specific conditions apply to that promotion.

You confirm that you are authorised to use the payment method supplied and that the payment and billing information is accurate. Payments are processed by Shopify and/or the payment providers displayed at checkout. We do not ask customers to provide passwords, authentication codes or complete payment-card details through customer support messages.

6. Processing, dispatch and delivery

Orders are normally processed and dispatched within 1–2 business days. This is the time required to prepare and hand the order to the carrier; it is not the delivery time. Delivery time after dispatch depends on the destination and selected shipping service. Further details are provided in our Shipping Policy.

Any delivery date or transit time is an estimate unless we expressly agree to a guaranteed date. We are not responsible for delays caused by events outside our reasonable control, but we remain responsible for fulfilling our obligations and will assist with delayed, lost or damaged shipments.

For consumer orders, the risk of loss or damage remains with Animaglass until the products are physically received by you or by a person designated by you. If you independently commission a carrier that was not offered by us, risk may pass when the products are handed to that carrier, as permitted by applicable law.

Please provide a complete and accurate delivery address. If a parcel cannot be delivered because the address supplied was materially incomplete or incorrect, additional delivery costs may apply where permitted by law.

7. Returns and the right of withdrawal

Animaglass offers a voluntary 30-day return period, beginning on the day you receive the product. The eligibility requirements and return procedure are described in our Refund Policy.

For consumers in the European Union and other jurisdictions providing equivalent rights, the statutory right to withdraw from an eligible distance contract generally lasts 14 days from receipt of the goods. No reason is required. The voluntary 30-day policy gives additional time but may apply conditions for returns made after the statutory withdrawal period.

During the statutory withdrawal period, you may inspect the product as you would in a physical shop. You may be responsible for any reduction in value resulting from handling beyond what is necessary to establish the product’s nature, characteristics and functioning.

Unless the product is defective, damaged, incorrectly supplied or applicable law provides otherwise, the customer is responsible for the direct cost of returning it. Please contact us before sending a return so that we can provide the correct instructions.

Nothing in the voluntary return policy limits your separate rights concerning defective or non-conforming goods.

8. Defective, damaged or incorrect products

Products sold to consumers are covered by the mandatory legal guarantee of conformity provided by applicable Romanian and European Union law. This legal protection is separate from our voluntary 30-day return period and does not require the purchase of an additional commercial warranty.

If a product arrives damaged, is incorrect, is missing from the delivery, does not correspond to its description or develops a problem that may be covered by the legal guarantee, contact us. Please provide the order number and, when useful, a clear photograph or short video showing the issue. Do not send passwords, authentication codes or complete payment details.

We will review the situation and provide the appropriate remedy under applicable law, which may include repair, replacement, a price reduction or a refund depending on the circumstances. The legal guarantee does not ordinarily cover normal wear, accidental damage, misuse or damage caused by modifications made after delivery.

9. Acceptable use

You may use the Services only for lawful purposes. You must not:

• use the Services to violate applicable law or the rights of another person;

• submit false, fraudulent, abusive, defamatory or misleading material;

• transmit malware or interfere with the operation or security of the website;

• attempt to gain unauthorised access to accounts, systems or data;

• circumvent access controls, CAPTCHAs, rate limits or other security measures;

• collect personal data without a lawful basis; or

• use automated systems in a manner that damages, overloads or materially disrupts the Services.

Normal indexing by search engines and responsible use of automated tools that respect applicable technical instructions, security measures and the law are not prohibited by this section.

We may restrict or suspend access where reasonably necessary to protect the Services, our customers or third parties, or where these Terms have been materially breached.

10. Intellectual property

The website and its content—including the Animaglass name and branding, product designs, text, photographs, graphics, videos, audio and the selection and arrangement of that content—are owned by Animaglass or used with permission and are protected by applicable Romanian, European Union and international intellectual-property laws.

You may access the website for personal, non-commercial use. Except where permitted by law, you may not reproduce, distribute, modify, publish, commercially exploit or create derivative works from our content without prior written permission.

Third-party names, logos, artwork and trademarks remain the property of their respective owners. No licence is granted except as expressly stated.

11. Reviews, feedback and submitted content

If you voluntarily submit a review, photograph, video, suggestion or other content (“Submitted Content”), you confirm that you have the right to submit it and that it does not violate the law, another person’s rights or these Terms.

You grant Animaglass a non-exclusive, worldwide, royalty-free licence to host, reproduce, display and adapt the Submitted Content for operating, improving and promoting the Services. This licence does not transfer ownership of your content to us. Where required by law, we will identify incentivised or sponsored reviews appropriately.

We may moderate or remove Submitted Content that is unlawful, abusive, misleading, irrelevant, infringes intellectual-property rights or otherwise violates these Terms. We are not required to publish or respond to every submission.

12. Third-party services and links

The Services may contain links to or features provided by third parties, such as payment providers, carriers, social-media services or embedded content. Third parties operate under their own terms and privacy policies.

We are not responsible for independent third-party websites or services that we do not control. This does not limit our responsibility for fulfilling your order or for third parties we use to perform our obligations where applicable law makes us responsible.

Questions concerning a transaction made directly with an independent third party should be addressed to that third party.

13. Shopify

Shopify provides the ecommerce platform used to operate this store. Your purchase is made from Animaglass. Shopify is not the seller of Animaglass products and is not responsible for fulfilling your order.

Shopify may process certain personal data and payment-related information as described in our Privacy Policy and in Shopify’s privacy information.

14. Privacy

Our collection and use of personal data are described in our Privacy Policy. By using the Services, you acknowledge that your information may be processed by Shopify and other service providers where necessary to operate the store, process payments, fulfil orders, provide support, prevent fraud and comply with legal obligations.

Any international transfer of personal data will be handled in accordance with applicable data-protection law.

15. Errors and availability

We may correct typographical errors, inaccurate descriptions, pricing errors, stock information or other mistakes on the website. If an error materially affects an order already submitted, we will contact you and, where necessary, give you the choice to confirm the corrected order or receive a cancellation and refund.

We do not guarantee that the website will always be uninterrupted or error-free. We may temporarily suspend access for maintenance, security or circumstances outside our reasonable control.

16. Disclaimer relating to website information

General informational content on the website is provided for convenience and should not be treated as professional legal, medical or technical advice. We take reasonable care over published information but do not guarantee that every general informational page will always be complete or current.

This disclaimer does not apply to contractual product descriptions, information that consumers are legally entitled to rely upon, or any warranty, guarantee or liability that cannot lawfully be excluded.

17. Liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, intentional misconduct, death or personal injury caused by negligence, defective products where mandatory product-liability law applies, or breaches of mandatory consumer rights.

Subject to the paragraph above and to the extent permitted by law, Animaglass is not responsible for indirect or unforeseeable losses arising from use of the Services. If you use the Services as a consumer, we are responsible for losses that are a reasonably foreseeable consequence of our breach of these Terms or failure to use reasonable care.

We are not liable for business losses where a product was purchased solely for personal or household use and was used for an unauthorised commercial purpose.

18. Events outside our reasonable control

We are not responsible for a delay or failure caused by events outside our reasonable control, such as severe transport disruption, natural disasters, widespread network failures, governmental measures or industrial action. We will take reasonable steps to minimise the effects and will contact affected customers when appropriate.

If such an event materially delays performance, any mandatory cancellation, refund or delivery rights available under applicable law remain unaffected.

19. Termination of website access

You may stop using the Services at any time. We may suspend or terminate access to an account or to restricted website features where reasonably necessary because of fraud, unlawful activity, a material breach of these Terms or a security risk.

Termination of website access does not cancel an accepted order or remove rights and obligations that arose before termination. Provisions that by their nature should continue—including those concerning intellectual property, liability, privacy and dispute resolution—remain applicable.

20. Severability, waiver and assignment

If any part of these Terms is found to be unlawful, invalid or unenforceable, it will be applied to the fullest extent permitted by law or, where necessary, separated from the remaining Terms. The remaining provisions will continue to apply.

If we do not immediately enforce a provision, that does not waive our right to enforce it later.

You may not transfer obligations under these Terms without our written consent. We may transfer our rights or obligations as part of a genuine transfer or reorganisation of the business, provided that doing so does not reduce your contractual or statutory rights. We will notify you where required by law.

Where there is doubt about the meaning of a written term in a consumer contract, it will be interpreted in accordance with applicable consumer-protection law, including the interpretation most favourable to the consumer where required.

21. Governing law and disputes

These Terms and contracts made through the Services are governed by Romanian law and applicable European Union law. If you are a consumer resident in another country, this choice of law does not deprive you of mandatory protections provided by the law of your country of residence.

We encourage you to contact us first so that we can try to resolve a concern directly. Consumers may also use any competent consumer-protection or alternative dispute-resolution service available under applicable law.

Any dispute may be brought before the competent courts determined by applicable law. Nothing in these Terms requires a consumer to bring proceedings exclusively in Romania where the consumer is legally entitled to use the courts of another jurisdiction.

22. Changes to these Terms

The current version of these Terms is available on this page. We may update the Terms when necessary, for example because of legal, operational or technical changes.

Material changes will be communicated where required by law and will take effect from the date stated in the notice. Changes will not retroactively alter orders or contracts already accepted unless required by law or expressly agreed with you.

23. Entire agreement and interpretation

These Terms, together with the policies expressly referenced in them and the order information presented at checkout, form the agreement governing your use of the Services and purchases from Animaglass.

If there is a conflict between these Terms and a mandatory provision of applicable consumer law, the mandatory provision prevails. Section headings are included only for convenience and do not affect interpretation.
